British Columbia Probate and Administration Forms Kit
Most estates need to be probated to enable the instructions in the will to be carried out. While many people believe only a lawyer can do this, that is not necessarily true.

The British Columbia Probate and Administration Forms Kit is designed for people with small or moderate estates to handle after the death of a family member or friend. When you probate an estate, you prove by a legal process that a will has been validly made and that you are entitled to distribute the assets. This may sound complicated, but it isn't.

It is actually possible for you as a layperson to probate an uncomplicated estate by yourself. Furthermore, you can save thousands of dollars in legal fees, as a lawyer would normally charge about two percent of the gross value of an estate. Which means, for a $100,000 estate you would probably be charged about $2,000.

By following the step-by-step instructions in this updated kit, you can successfully probate an estate yourself. And even if you are not planning to do it yourself, the included book will serve as a useful guide in discussions with your lawyer.

Some of the topics that are explained:
  • What you should do after a death
  • How you save money by doing the probate yourself
  • The powers and duties of executors and administrators
  • What forms are necessary and how to complete them properly
  • How to assess the value of the deceased’s assets
  • What to do about out-of-province assets
  • How to provide cash immediately for the family
  • How to transfer the estate to the rightful beneficiaries
  • Survivor’s benefit plans under the Canada Pension Plan and veterans’ pensions
The kit contains the following:
  • The Probate Guide for British Columbia
  • A complete set of printed probate forms
  • Probate forms on the CD-ROM
  • Administration forms on the CD-ROM
Also included in the package is a CD-ROM with copies of all the forms in MS Word and PDF formats for use on a PC.
