The Employment Standards Act, 2000 (ESA, 2000) sets out the rights and responsibilities of employees and employers in Ontario workplaces. The standards outlined in the ESA, 2000 represent the minimum standards that employers must provide to their employees.

The Ontario Employment Standards Act: Quick Reference, 2011 Edition focuses on the key obligations for employers under this broad piece of legislation. If your responsibilities include hiring of employees or managing and supervising, or payroll, or any duty that requires you to make decisions regarding employment policies, you can be at legal risk if you don't adhere to the Employment Standards Act, 2000. This edition includes information about major employment standards developments over the past 12 months, plus expanded sections, such as:
  • A significant new piece of legislation called the Employment Protection for Foreign Nationals Act (Live-in Caregivers and Others), 2009, which came into force on March 22, 2010. This legislation contains employment-related protections for foreign nationals who are working or looking for work in Ontario, and incorporates by cross-reference many provisions of the ESA, 2000.
  • The Ministry of Labour's education, outreach and partnership initiative, which commenced in 2009, with the goals of helping employers and employees to understand their rights and obligations under the ESA, 2000, providing employers with resources and tools to help them comply with the ESA, 2000, and reducing the incidence of employment standards claims.
  • The Ministry of Labour's Employment Standards Task Force, which was formed in August 2010 with the goal of eliminating a backlog of approximately 14,000 employment standards claims.
  • Information about lay-off and mass termination rules as they apply to temporary help agency employees.
  • Information about the exemptions applicable to certain types of elect to work employees.
