Description:

For “good labour relations sense,” turn to the convenient, comprehensive text that is the choice of labour professionals across Canada. You’ll quickly come to rely on its useful features, such as:
  • A current consolidation of the Canada Labour Code, the Canada Industrial Relations Board Regulations, 2001, plus 11 other ancillary enactments
  • Thousands of case law digests, covering both reported and unreported decisions of the Board and the courts, fully annotating the Code and the Board Regulations, including many new cases considering the substantive amendments made to Parts I and II of the Code
  • Exhaustive cross-referencing to related provisions.
The 2008 edition of The Annotated Canada Labour Code provides you with insight into the interpretation and application of Parts I (union concerns), II (safety & health) and III (labour standards, leaves, terminations, recovery of wages, sexual harassment).

Highlights for the 2008 Edition:
  • Canada Industrial Relations Board has confirmed its right to review settlement agreements and to enforce their terms;
  • the obligation of good faith negotiations following a strike vote;
  • the right of employers to raise allegations of union coercion during the certification process;
  • further edification on the issue of when employers will be considered to be “actively engaged” in the longshoring industry;
  • on Part II concerns, clarification is provided as to when parties can interfere with accident scenes;
  • further elaboration is given on the necessary content of safety officer directions;
  • on Part III matters, the court confirms the necessity of decision makers to avoid familiar or friendly interactions with witnesses during a hearing as well as commenting on the binding effect of settlement agreements on parties.
This edition of the Annotated Canada Labour Code sets out the 1985 revised statute (and all other statutes in this text) as amended to Canada Gazette, Pt. III, vol. 30:2 (July 31, 2007). The regulations cited have been amended to Canada Gazette, Pt. II, vol. 141:22 (October 31, 2007).
