Description of last year's 2011 edition:

Designed with the busy practitioner in mind, the Annotated Ontario Rules of Criminal Practice puts this crucial information at your fingertips.

This work annotates the Ontario Rules of Criminal Practice relating to criminal trial and appeal proceedings, and applications for extraordinary remedies. It includes the full text of the Criminal Appeal Rules and the Superior Court of Justice Rules.

New in the 2011 edition:
  • Notice to the Profession: Electronic Delivery of Copies of Reasons for Judgement
  • Best Practices for Civil Applications and Motions
  • Changes to The Rules Regarding Notice Requirement
Some highlights from recent case law include:
  • R. v. Cunningham 2010 S.C.C. 10 reversing (2008), 59 C.R. (6th) 49 (Y.T.C.A.). The court has the authority to require counsel to continue to represent an accused when defence counsel, in a criminal matter, wishes to withdraw because of non-payment of legal fees.
  • R. v. Bitternose (2009), 66 C.R. (6th) 260 (Sask. C.A.) Whether to grant or refuse a request for adjournment because an accused is not represented by counsel in a criminal trial is a discretionary decision but must be based on reasons well-founded in the law.
