Some highlights from recent case law include:
  • R. v. Cunningham 2010 S.C.C. 10 reversing (2008), 59 C.R. (6th) 49 (Y.T.C.A.). The court has the authority to require counsel to continue to represent an accused when defence counsel, in a criminal matter, wishes to withdraw because of non-payment of legal fees.
  • R. v. Bitternose (2009), 66 C.R. (6th) 260 (Sask. C.A.) Whether to grant or refuse a request for adjournment because an accused is not represented by counsel in a criminal trial is a discretionary decision but must be based on reasons well-founded in the law.
